These Terms of Service (“Terms”) govern your access to and use of the websites, applications, APIs, and related services offered by Woizer (“Woizer,” “we,” “us,” or “our”) (collectively, the “Services”). By creating an account, clicking to accept these Terms, or using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Services.
1. Agreement to Terms
By accessing or using Woizer, you confirm that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and Woizer. Our Services allow you to create, configure, deploy, and manage AI-powered voice agents for your business.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep your account information up to date. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms or for fraudulent purposes.
4. Description of Services
Woizer provides an AI voice agent platform that enables businesses to deploy intelligent voice and chat agents. Our Services include:
- Automated website scanning and knowledge base generation
- AI-powered voice agents for phone calls and website widgets
- Call recording, transcription, and AI-generated summaries
- A management dashboard with analytics and configuration tools
- Integration capabilities with third-party services
We may modify, update, or discontinue features of the Services at any time with reasonable notice where practicable.
5. Free Tier & Billing
Free until you deploy
You can build, configure, and test your AI agent entirely for free. Charges begin only when you actively deploy your agent by embedding the voice widget on your website or connecting a phone number. There are no hidden fees during the setup and testing phase.
Our paid plans are as follows: Starter ($49/month), Growth ($99/month), and Pro ($199/month). Each plan includes a specified allocation of minutes, features, and support levels as described on our pricing page.
Subscriptions renew automatically at the end of each billing period unless cancelled prior to renewal. All fees are exclusive of applicable taxes. You may cancel your subscription at any time through your dashboard; cancellation takes effect at the end of the current billing period.
We reserve the right to change our pricing with at least 30 days advance notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.
6. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Infringe upon the intellectual property or privacy rights of others
- Generate or distribute harmful, abusive, fraudulent, or misleading content
- Impersonate any person or entity, or misrepresent your affiliation
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Use the Services in any manner that could overburden our infrastructure
- Reverse engineer, decompile, or attempt to extract source code from the Services
- Resell or redistribute access to the Services without our written consent
We may investigate violations and may suspend or terminate your access if we reasonably believe you are in breach of these Terms.
7. Data & Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
Call recordings & transcriptions
When you deploy a voice agent, calls are recorded and transcriptions are generated automatically. These recordings and transcripts are stored securely and used for service delivery (providing you with call history, summaries, and analytics) and for improving the quality and accuracy of our AI systems. You are responsible for informing your end users about call recording in accordance with applicable laws.
You retain ownership of your content. By using the Services, you grant Woizer a non-exclusive, worldwide license to process your content solely as necessary to provide, maintain, and improve the Services.
8. Intellectual Property
Woizer and its licensors retain all rights, title, and interest in and to the Services, including all software, algorithms, models, documentation, branding, and related intellectual property. These Terms do not grant you any rights to use our trademarks, logos, or brand features without prior written consent.
You retain all rights to content you submit to the Services. We do not claim ownership of your business data, knowledge base content, or configurations.
9. AI-Generated Content
Important disclaimer
Responses generated by Woizer's AI agents are produced by artificial intelligence and may not always be accurate, complete, or appropriate. AI-generated content does not constitute professional advice (legal, medical, financial, or otherwise). You are responsible for reviewing AI outputs and ensuring they are suitable for your use case. Woizer is not liable for decisions made based on AI-generated responses.
10. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access for material breach of these Terms, risk to security or other users, non-payment, or as required by law.
Upon termination, your right to use the Services ceases immediately. We may retain certain data as required by law or for legitimate business purposes (such as fraud prevention and record-keeping). Provisions that by their nature should survive termination will remain in effect.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Woizer and its affiliates, officers, directors, employees, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Services, regardless of the theory of liability.
Woizer's total aggregate liability arising out of or related to these Terms or the Services shall not exceed the greater of (a) the amounts you paid to Woizer in the twelve (12) months preceding the event giving rise to liability, or (b) one hundred U.S. dollars (USD $100).
12. Changes to Terms
We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. For material changes, we will provide additional notice (such as an email or in-app notification) at least 30 days before the changes take effect. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv-Yafo, Israel, subject to any mandatory consumer protection rights in your jurisdiction.
